AGREEMENT FOR INSTALLATIOn[ AND MAII.~TENANCE <br /> <br />OF LANDSCAPING <br /> <br /> THIS AGREEMENT is made this ~/~-~ day of May , <br /> <br />19 84 , between JOHN CLOSE , <br /> <br />hereafter referred to as "Property Owner" and the CITY OF PLEASANTON, <br />a municipal corporation, hereafter referred to as "City". <br /> <br /> RECITALS <br /> <br /> THIS AGREEMENT IS BASED UPON THE FOLLOWING FACTS: <br /> <br /> (1) Property owner is the owner of real property in the City of <br />Pleasanton described in Exhibit "A", attached to this Agreement and <br />made a part of it by this reference; <br /> <br /> (2) On September 14 <br />of Adjustment variance <br /> <br />(3) By the terms of <br /> <br /> , 19 84 , the City granted a Board <br /> approval to said property; <br /> <br />the Board of Adjustment approval, property <br /> <br />owner is required to install and maintain landscaping in accordance <br />with a plan, to be approved by the Planning Department prior to Build- <br />ing Permit approval; <br /> <br /> (4) Both parties recognize that the installation and maintenance <br />of landscaping is an integral part of the property owner's plan for <br />development of the property. <br /> <br />NOW, THEREFORE, IT IS AGREED BETWEEN THE PARTIES, as follows: <br />1. Purpose. The purpose of this Agreement is to assure (a) <br />installation in accordance with the landscaping plan previously <br />approved by the City and (b) continued maintenance and care of the <br />landscaping. <br /> <br /> <br />
