~OARD OF ADJUSTMENT
CITY OF PLEASANTON
COUNTY OF ALAMEDA
STATE OF CALIFORNIA

RESOLUTION NO. R-83-19

A RESOLUTION OF THE BOARD OF'ADJUSTMENT
OF THE CITY OF PLEASANTON APPROVING A
VARIANCE FOR CORK HARBOUR AS FILED
UNDER CASE V-83-23

WHEREAS, Cork Harbour Company has applied for a variance from
the requirements of the zoning ordinance to allow
the construction of fences, Six feet in height, within ..
required sideyards of corner lots at 645, 657 and
673 Abbie Street and 4881 and 4898 Cobbler Court; and

WHEREAS, zoning for the property is PUD-(Planned Unit Development)-/
Medium Density Residential District; and

WHEREAS, at their duly noticed public hearing of September 14, 1983
the Board of Adjustment considered all public testimony,
exhibits and recommendations of the City staff; and

WHEREAS, City staff has determined that 4881 Cobbler Court does
not need a variance to construct a fence and this structure
can be built within the required setbacks; and

WHEREAS, the Board of Adjustment found that, a) because of the
fact that the rear yards of the subject properties are
depressed below the level of the adjacent street,
the strict application of the provisions of the ordinance
code would deprive all four properties of the rear
yard privacy enjoyed by other properties in the vicinity"'
and under identical zoning; b) that because the special
circumstance mentioned in subparagraph a above, the
granting of this variance will not constitute a grant
of special privilege inconsistent with the limitation
of other properties classified in the same zoning
district; and c) that the granting of the variance
will not be detrimental to the public health, safety
or welfare or be materially injurious to properties
or improvements in the vicinity.

NOW, THEREFORE, THE BOARD OF ADJUSTMENT OF THE CITY OF PLEASANTON '
RESOLVES THE FOLLOWING:--' ......- ....
Section 1.
