Railroad hereby grants to Grantee, subject to the reservations, <br />covenants and conditions herein contained, the right to construct, recon- <br />struct, maintain and operate approximately one hundred ninety (190) feet <br />of fifteen (15) inch reinforced concrete drain pipe and approximately <br />two hundred twenty (220) feet of twelve (12) inch corrugated metal drain <br />pipe, hereinafter collectively referred to as "structure," in, upon, along <br />across and beneath property and tracks of Railroad, at or near Pleasanton, <br />in the County of Alameda, State of California, between and opposite <br />Engineer's Stations 1478+70 and 1482+66, Mile Post 66.2, in the locations <br />shown on the print of Railroad's Drawing 198958 dated April 14, 1983, <br />attached and made a part hereof. <br />Said structure shall be installed in accordance with minimum require <br />ments of Form C. S. 1741, also attached and made a part hereof. <br />1-a. Upon execution hereof, Grantee shall pay to Railroad the sum <br />of Three Hundred Twenty-five Dollars ($325). <br />In addition and as part consideration for the rights herein granted, <br />Grantee shall pay to Railroad Two Hundred Fifty Dollars ($250) per annum, <br />payable annually in advance. Such rental may be revised annually by Rail- <br />road by the percentage of any increase (to the nearest one-tenth of one <br />percent) which may have occurred in the Consumer Price Index (Consumer <br />Price Index, Urban Wage Earners and Clerical Workers, U. S. City Average, <br />All Items [1967=100], as published by the U. S. Department of Labor, <br />Bureau of Labor Statistics --or any replacement for that Index published <br />by said Department or any other U. S. governmental agency) during the <br />-1- <br />
