THE FOLLOWING RESOLUTION WAS ADOPTED: NUMBER. -J,930 .. CONSTRUCTION AND MAINTENANCE AGREEMENT WITH THE CITY OF PLEASANTON, THE COUNTY OF ALAMEDA, THE SOUTHERN PACIFIC TRANSPORTATION COMPANY, AND THE WESTERN PACIFIC RAILROAD COMPANY IN CONNECTION WITH THE NILES- PLEASANTON TRACK CONSOLIDATION PROJECT WHEREAS, the County of Alameda plans to reconstruct the existing underpass on Pleasanton-Sunol Road, under the tracks and right-of-way of The Western Pacific Railroad Company, and to cooperate with the City of Pleasanton in connection with other railroad grade crossing and separation improvements; and WHEREAS, Section 2456 of the Streets and Highways Code of the State of California requires that local agencies requesting an allocation of State funds to finance the con- struction of grade separation projects execute an agreement with the affected railroad or rai 1 roads ;' and WHEREAS, the City of Pleasanton, the County of Alameda, the Southern Pacific Transportation Company, and.The Western Pacific Railroad Company propose to enter into an agreement relating to the construction and maintenance of a comprehensive grade separa- tion and grade crossing elimination project, designated therein as the Niles -Pleasanton. Track Consolidation Project, including reconstruction of the existing underpass at the point of intersection of said Pleasanton-Sunol Road with the right-of-way of the said Western Pacific Railroad Company; NOW, THEREFORE, BE IT RESOLVED that this Board of Supervisors hereby approves that certain agreement between the City of Pleasanton, the County of Alameda, The Western Pacific Railroad Company, and the Southern Pacific Transportation Company in connection with the construction and maintenance of the Niles -Pleasanton Track Consolidation Project; and BE IT FURTHER RESOLVED, that the Chairman of this Board of Supervisors be and he is hereby authorized and directed to execute the aforesaid agreement on behalf of the said County of Alameda.
