City of Pleasanton–Spotorno Ranch Reduced Development Project
Initial Study/Consistency Checklist Environmental Checklist

FirstCarbon Solutions 83
https://adecinnovations.sharepoint.com/sites/PublicationsSite/Shared Documents/Publications/Client (PN-JN)/2148/21480021/Consistency Checklist/21480021 Spotorno Ranch Consistency Checklist ScreenCheck.docx
MM J1 A California Tiger Salamander Mitigation and Monitoring Plan must be prepared and
submitted to the California Department of Fish and Game (DFG)21 for review and
approval. Approval of the plan must be obtained from DFG.
Timing: Prior to the issuance of any grading permits that affect tiger salamander
habitat.
MM J3 A pre-construction survey of the Spotorno residential development areas (Spotorno
Flat and Upper Valley), Golf Course, and Golf Course Housing areas must be
completed to verify the presence or absence of active raptor nests. If any active
nests are found, construction must be scheduled so that it will not result in removal
or abandonment of an active raptor nest.
Timing: Prior to the start of construction activities.
MM J6 DFG must be consulted regarding any areas subject to their jurisdiction prior to any
encroachment into a designated corridor, and/or consultation with the Corps prior
to any activity that would occur within the jurisdictional limits of wetlands or within
the bed and bank of a waters of the United States.
Timing: Prior to the issuance of a grading permit in applicable areas.
MM J10 Provide such additional mitigation of wetland impacts as may be required by the
Army Corps of Engineers upon its review of applications for fill permits. The Corps
may find the mitigations adequate, or may require additional measures preliminary
to issuing fill permits.
Timing: Prior to the issuance of grading permits for the applicable areas.
Proposed refinements to mitigation language
The following refinements to MM J3 in the 1998 HVSP FEIR are proposed to be included in the
conditions of approval for the Spotorno Project, and would provide enhanced protection to special-
status species, in accordance with the intent of MM J3:
Pre-construction surveys of the Spotorno Flat Area shall be conducted to verify the presence or
absence of burrowing owl and American badger. These surveys should be conducted between 4
months and 2 weeks prior to ground-breaking activities. If found to be present, avoidance or
minimization measures shall be implemented, as needed, to protect these species during
construction.
Conclusion
The 1998 HVSP FEIR found that impacts to biological resources would be less than significant with
the incorporation of mitigation measures. Subsequent studies in 2017 and 2021 generally confirm
the conclusions of the 1998 HVSP FEIR, and also indicate that the protections afforded by MM J3

21 When the HVSP FEIR was prepared in 1998, the correct agency was the California Department of Fish and Game. Subsequently, this
has become the California Department of Fish and Wildlife (CDFW).
