Cities of Dublin and Pleasanton | Disaster Debris Management Plan | 2022 <br /> <br />160 <br /> <br />Attachment G: Sample Debris Management Site Memorandum of <br />Agreement <br /> <br />This Memorandum of Agreement made and entered into this ______ day of ________ ENTER <br />YEAR, by and between (hereinafter “OWNER”), and the City of _____________, California <br />(hereinafter “CITY”) (collectively referred to hereinafter as “the Parties”). <br /> <br />WHEREAS, the CITY has a debris management plan for the removal, reduction, and disposal of <br />large volumes of debris from public property following large scale disasters; and <br /> <br />WHEREAS, pursuant to the CITY debris management plan, the CITY may or may not enter into <br />an agreement with one or more contractor(s) to manage and operate the removal, reduction, and <br />disposal of disaster generated debris depending on the severity of the incident; and <br /> <br />WHEREAS, OWNER is the owner of a tract of land in ENTER TRACT OF LAND LOCATION <br />(hereinafter “the Property”), more particularly described in Exhibit A attached hereto; and <br /> <br />WHEREAS, the CITY has identified the Property owned by OWNER as a suitable location for a <br />Debris Management Site (“DMS”), to be used by the CITY in the event of a disaster necessitating <br />debris removal, reduction, and disposal; and <br /> <br />WHEREAS, the CITY and the OWNER have agreed to cooperate toward establishment of a DMS <br />to be used by the CITY, or its designees, in the event of emergency assistance efforts requiring <br />debris removal, reduction, and disposal in the City. <br /> <br />Now therefore, the Parties agree as follows: <br />I. PROPERTY <br />The Property, as shown and identified as DMS on Exhibit A, constitutes approximately ____ acres <br />available for DMS operations. The physical location of the site is: <br />_____________________________ and is a portion of property owned by OWNER identified as: <br />____________________ Real Estate ID#: ___________________. <br /> <br />II. TERM <br />Subject to early termination as permitted by Section V herein below, this Agreement shall be for <br />a term of ____________________ from the date of the Agreement without regard to the <br />Commencement Date (as hereinafter defined). <br /> <br />III. AGREEMENT <br />OWNER, subject to the terms and conditions set forth herein, hereby agrees to the use of the <br />Property by the CITY for purposes of staging, storing, reducing, and properly disposing of disaster <br />generated debris following a natural or man-made event. <br /> <br />IV. CITY OBLIGATIONS
