Box 520 <br />Pleasanton, California 94566 <br /> <br /> Y of Document Recorded <br />°n 433908 <br />Has not been compared with Original, <br />ALAMEDA COUNTY RECORDER <br /> <br />LANDSCAPING MAINTENANCE AGREEMENT <br /> <br /> THIS LANDSCAPING MAINTENANCE AGRI}~VIENT is made and entere, d <br />into this t~'~ th day of ,~'~2. ~ ,200~,-'oy and between the City ot <br />Pleasanton ("City") and GTE Mobilnet of California Limited Parmership, dba Verizon <br />Wireless, by Cellco Partnership, its general partner ("Developer"). <br /> <br />RECITALS <br /> <br /> WHEREAS, Developer leases a portion of real property commonly known as <br />3470 Boulder Street, Pleasanton, California, ("Property") and more particularly described <br />in Exhibit A.., which is attached and incorporated into this Agreement by this reference; <br /> WHEREAS, on March 31, 2003, the City approved PDR-259 for design review <br />of a personal wireless service facility ("Project"); <br /> WHEREAS, Condition 10 of the Conditions of Approval requires the Developer <br />to enter into an agreement with the City to maintain all landscaped and open space areas <br />related to the Project in a healthful, attractive and weed-free manner at all times, and that <br />such landscaping agreement shall mn with the land for the duration of the existence of <br />the Project; and <br /> <br /> NOW, THEREFORE, in consideration of the mutual promises contained in this <br />Agreement, the parties agree as follows: <br /> 1. Purpose. The purpose of this Agreement is to assure: (a) installation of <br /> landscaping in accordance with the City-approved landscape plan for the Project; and Co) <br /> continued maintenance and care of the landscaping and open space areas. <br /> 2. Landseanim!. Developer, at no expense to the City, shall maintain in <br /> healthful, attractive and reasonably weed-free manner all the landscaped and open space <br /> areas related to the Project as shown in the landscaping plan approved by the City for the <br /> duration of the existence of the Project. <br /> <br /> 3. Maintenance Requirements. "Landscaped and open space areas" as used <br /> in this Agreement shall mean plantings and irrigation systems which have been installed, <br /> or are proposed to be installed, pursuant to the City approved landscaped plan for the <br /> <br /> <br />
