All work, including site restoration of debris management sites, prior to close -out shall be <br />completed within 30 calendar days after receiving notice from the City that the last load of <br />debris has been delivered, unless the City initiates additions or deletions to the agreement <br />in writing. Subsequent changes in completion times shall be equitably negotiated by both <br />parties pursuant to applicable state and federal laws. Liquidated damages shall be <br />assessed at $2,000.00 per calendar day for any time over the maximum allowable time <br />established. <br />f. The amounts specified above are mutually agreed upon as reasonable and proper amount <br />of damage the City should suffer by failure of the Contractor to complete requirements set <br />forth in the scope of work. <br />Contract term <br />The initial contract term will be for five (5) years with an optional three (3) year and two (2) year <br />extension allowing for a ten (10) year total contract term. Prices will be reviewed at each optional <br />renewal and increased, if necessary, based on review of the consumer price index (“CPI”). <br />Retainage <br />The City will hold a 10% retainage on all Contractor invoices until satisfactory completion of the <br />project and resolution of all damages. <br />
