Indemnity, Insurance, Bond Franchise Agreement with Pleasanton Garbage Service City of Pleasanton Page 113 June 7, 2022March 8, 2018 Any failure to comply with reporting provisions of the policies shall not affect coverage provided to the 3971 City, its officials, employees, or volunteers. 3972 Coverage shall state that the Contractor's insurance shall apply separately to each insured against whom 3973 claim is made or suit is brought, except with respect to the limits of the insurer's liability. 3974 B. Workers' Compensation and Employers Liability Coverage. The insurer shall agree to waive all 3975 rights of subrogation against the City, its officers, employees, and volunteers for losses arising from 3976 work performed by the Contractor for the City. 3977 C. All Coverages. Each insurance policy required by this clause shall be endorsed to state that coverage 3978 shall not be suspended, voided, canceled by either Party, reduced in coverage or in limits except 3979 after thirty (30) calendar days prior written notice by certified mail, return receipt requested, has 3980 been given to the City. 3981 9.5.5 Acceptability of Insurers 3982 The insurance policies required by this Section shall be issued by an insurance company or companies 3983 authorized to do business in the State of California and with a rating in the most recent edition of Best's 3984 Insurance Reports of size category VII or larger and a rating classification of A or better. 3985 9.5.6 Verification of Coverage 3986 Contractor shall furnish Contractor’s insurance agent a copy of these specifications, and direct the agent 3987 to provide the City with certificates of insurance and with original endorsements affecting coverage 3988 required by this clause. Issuance of documentation indicates the Contractor’s insurance complies with 3989 these provisions. The certificates and endorsements for each insurance policy are to be signed by a Person 3990 authorized by that insurer to bind coverage on its behalf. The certificates and endorsements are to be 3991 received and approved by the City before work commences. The City reserves the right to require 3992 complete, certified copies of all required insurance policies, at any time. 3993 9.5.7 Required Endorsements 3994 A. The Workers' Compensation policy shall contain an endorsement in substantially the following 3995 form: 3996 “Thirty (30) calendar days’ prior written notice shall be given to the City of Pleasanton 3997 in the event of cancellation, reduction in coverage, or non-renewal of this policy.
