(ii) alleging that an entity is out of compliance with SB 1383. 223 1.37 "Compost (or Composting)" means a method of treatment in which organic wastes are 224 biologically decomposed under controlled, aerobic, or anaerobic conditions to produce a safe 225 and nuisance-free Compost Product. 226 1.38 “Compostable Plastics” or “Compostable Plastic” means plastic materials that meet the ASTM 227 D6400 standard for compostability. 228 1.39 “Compost Product” means the product resulting from the controlled biological decomposition of 229 Organic Materials that are Source Separated from the municipal Solid Waste stream, or which are 230 separated at a centralized facility. 231 1.40 "Construction and Demolition Debris (or C&D)" means used or discarded construction materials 232 removed from Premises during the construction or renovation of a structure resulting from 233 construction, remodeling, repair, or demolition operations on any pavement, house, Residential 234 property, Commercial building, or other structure. 235 1.41 "Container" means a receptacle for temporary storage of Solid Waste, Organic Materials, or 236 Recyclable Materials to be Collected by Contractor. Container includes a Cart, Bin, Drop Box, or 237 Compactors. 238 1.42 "Contractor" means Pleasanton Garbage Service, Inc. or PGS, a corporation organized and 239 operating under the laws of the State of California and its officers, directors, employees, agents, 240 companies and Subcontractors. 241 1.43 "Contractor’s Compensation" means the monetary compensation received by Contactor from 242 Customers in return for services provided by Contractor in accordance with this Agreement as 243 described in, and pursuant to Article 8. 244 1.44 "Contractor’s Proposal" means the proposal submitted by Contractor on June 23, 2017 for 245 provision of Solid Waste, Recyclable Materials, and Organic Materials services in the City as 246 modified by this Agreement and Exhibit F, which is incorporated by reference. 247 1.45 "Curb or Curbside" means the location for placement of a Cart for pick-up by Single-Family 248 Customers, which shall be on the street against the face of the Curb, or where no street Curb 249 exists, the Container shall be placed not more than five (5) feet from the outside edge of the 250 street nearest the property’s entrance. In the case of condominiums and townhomes receiving 251 Single-Family service, placement of Carts shall be adjacent to each Residential unit at a location 252 agreed upon by both Contractor and Customer. 253 1.46 “Customer” means the Person to whom Contactor submits billing invoices and from whom 254 Contractor collects payment for Collection services provided to a Premises.
