The proposed project
would also be required to follow procedures outlined in Section 7050.5 of the California Health and
Safety Code and Public Resources Code Section 5097.98 as well as Prior EIR MM 4.D-4. Therefore,
there are no environmental effects that are peculiar to the proposed project or the parcels on which
the proposed project would be located. Impacts would be less than significant, and the proposed
project would not result in a new or more severe adverse impact that was not previously identified
in the Prior EIR.
Tribal Cultural Resources
Additional Checklist questions were added to the CEQA Guidelines Appendix G Checklist in 2016 and
did not exist at the time the Prior EIR was certified. These checklist questions address TCRs in its own
topical section and considered whether the proposed project would cause a substantial adverse
change in the significance of a tribal cultural resource, defined in Public Resources Code Section
21074 as either a site, feature, place, cultural landscape that is geographically defined in terms of the
size and scope of the landscape, sacred place, or object with cultural value to a California Native
American tribe, and that is:
• Listed or eligible for listing in the California Register of Historical Resources, or in a local
register of historical resources as defined in Public Resources Code Section 5020.1(k), or
• A resource determined by the lead agency, in its discretion and supported by substantial
evidence, to be significant pursuant to criteria set forth in subdivision (c) of Public
Resources Code Section 5024.1. In applying the criteria set forth in subdivision (c) of
Public Resource Code Section 5024.1, the lead agency shall consider the significance of
the resource to a California Native American tribe.

d) e) Tribal Cultural Resources
Prior EIR Conclusions
This checklist question did not exist when the Prior EIR was certified and was not discussed in the
Prior EIR.
Analysis of Proposed Project
The results from the NWIC records search indicated that no prehistoric cultural resources have been
recorded within the project site or its 0.5-mile search radius, additionally, the pedestrian survey
failed to locate or identify any cultural resources. However, On December 9, 2022, FCS staff sent a
letter to the NAHC in an effort to determine whether any sacred sites are listed on its Sacred Lands
File for the project site. On November 15, 2022, FCS received a response from the NAHC stating that
the results of the Sacred Lands File search were positive, indicating that there may be TCRs within
the project site or its 0.5 mile search radius. The NACH letter recommended reaching out to a list of
tribal representatives to obtain additional information.
To ensure that all Native American knowledge and concerns over potential TCRs that may be
affected by the proposed project are addressed, a letter containing project information and
