We will also need to ensure that Summerhill does not operate a private utility. All of which
can be clarified in an agreement with Summerhill.
Thanks,
Nelson-
P.S. Goes without saying that any future liability with Zone 7 connection fees resides with Summerhill, not the City.
From: Martin Inderbitzen [mailto:ndrbtzn@hotmail.com]
Sent: Monday, October 19, 2015 9:46 AM
To: Nelson Fialho; Steve Kirkpatrick
Cc: kevin Ebrahimi; Hickey, John; Larissa Seto; Jonathan Lowell
Subject: FW: SummerHill Homes
Nelson and Steve,
per our discussion on October 6 please see the email below from Zone 7 confirming that the 94 meters at the
individual units are not subject to a Zone 7 connection fee so long as the 3 omni meters remain in place.
Subsequent to our meeting (and after I sent the request to Zone 7) Steve Kirkpatrick contacted me to indicate
a concern about the responsibility of the City for water quality beyond the omni meters to the individual
condominium units. Steve, have I stated your concern correctly?
Based upon the response below from Zone 7 1 would conclude that, notwithstanding our understanding that
the water lines as well as the 94 meters would be a "private system", the City could "own" the water lines in
an easement through the HOA property to the 94 individual meters. However, I believe that the meters
themselves must be designated "private". As you recall, we have always agreed to purchase the 94 meters
from the City so as to insure that they meet all the same specifications of all other meters in the City including
the ability to read them remotely.
It is our hope that with this response we may now proceed to complete the documentation of the system and
proceed to permits. Please let me know if we need to discuss this further,
Thank you,
Marty Inderbitzen
