2

a. City and District agree to use the Park as a joint use facility. Subject to
the limitations below, the District may use the Park as its school
playground during periods when school is in session, including summer
school.

b. District agrees to obtain the necessary use permits from the City's Library
and Recreation Department before conducting any organized activity or
event, including, but not limited to, a school carnival or organized sports
events at the Park.

3. Maintenance. Except as provided below, the City will be responsible for
maintaining the Park, including determining the appropriate level and schedule of
maintenance.

a. Prior to the start of each school year, the District shall provide to the City
a schedule of regular daily activities (i.e., physical education classes,
recess and lunch periods, etc.) for the school year and a calendar
identifying school holidays and other days when the District will not use
the Park. The District will schedule its use of the Park in order for City to
perform regular Park maintenance during the school year.

b. The City will follow their pesticide policy for weed abatement and will
provide the District with the Safety Data Sheets (SDS) upon request for
the pesticides being applied. Following Healthy Schools Act requirements,
the City will post warning signs in the area where a pesticide will be
applied, at least 24 hours before and 72 hours after the application. City
will notify the District’s IPM Coordinator of the application date at least
five working days prior to the scheduled application. Applications may be
canceled on short notice due to unfavorable weather conditions. In such
cases, City will notify the District’s IPM Coordinator of the cancellation.
To the greatest extent possible, City will make applications when school is
not in session on school holidays and breaks (e.g. Thanksgiving break,
winter break, spring break). Prior to the start of the school year, the City
can provide the District with a list of products that will be used in the
Park.

c. By May 1st of each year, the District shall provide to the City the schedule
for summer school. While the City will make every effort to
accommodate the District's summer school schedule, the parties
acknowledge that the City may need to close access to all or part of the
Park during the months of June, July and August in order to complete
major maintenance activities.

d. In the event of a conflict between City maintenance and District activities,
the parties shall coordinate to accommodate each party’s reasonable needs.
