1 MEMORANDUM OF UNDERSTANDING AND LICENSE AGREEMENT BETWEEN CITY OF PLEASANTON AND PLEASANTON UNIFIED SCHOOL DISTRICT (Fencing at Fairlands Elementary School) THIS AGREEMENT (“Agreement”) is made and entered into this _____ day of _____________, 2024, by and between the CITY OF PLEASANTON, a municipal corporation (“City”) and the PLEASANTON UNIFIED SCHOOL DISTRICT (“District”), each also individually referred to as “Party” and collectively referred to as the “Parties.” RECITALS A. Sections 10900-10914.5, inclusive, of the California Education Code authorize cities and school districts to organize, promote and conduct programs of community recreation as well as contribute to the attainment of general education and recreational objectives for children and adults of the State; and B. District owns certain real property located at 4151 West Las Positas Boulevard within the City limits, upon which it operates Fairlands Elementary School (“FES”), and which District’s Property is depicted on the attached EXHIBIT A; and C. District seeks use of the City Property (Parcel 946 110600102) adjacent to the District’s FES and the City’s Fairlands Park (“Licensed Area”) and which Licensed Area is depicted on the attached EXHIBIT B; and D. District is willing to construct a fence around the perimeter (“Fence Work”) of the Licensed Area that City and District’s staff will determine location by mutual agreement; and E. Parties desire to enter into this License Agreement to clarify and memorialize the Parties’ understanding and define each Party’s obligations relating to the Licensed Area, Fence Work, Public Access, and Maintenance. AGREEMENT NOW THEREFORE, in consideration of the mutual covenants and conditions in this Agreement, City and School District agree as follows: 1.
