Page 2
2. Waivers
CDP requests the following waivers from City development standards.
a. Site Area Per Dwelling Unit
CDP requests a waiver to the minimum site area per dwelling unit of 1,500 square feet,
and, where parking is provided in the same structure it serves, 1,200 square feet (Mun. Code,
§ 18.36.060). The Project would include units with site areas equal to approximately 565 square
feet, which is less than required. (The project also includes units with 1,691 square feet of site
area but these units provide parking in the same structure it serves.) Accordingly, the Project
requests a waiver of the minimum site area per dwelling unit requirement to allow it to fit the
units allowed by the Property’s density. Without this waiver, the Project would need to provide
more site area to each unit, reducing the number of units that would fit on the site.
b. Minimum Lot Width
CDP requests a waiver to the minimum lot width of 80 feet to allow lot width as small as
61 feet. This waiver supports and is derivative of the requested incentive. In addition, absent this
waiver, the Project could not fit as many lots as proposed within the Property, which would
result in fewer condominiums than proposed.
c. Minimum Lot Depth
CDP requests a waiver to the minimum lot depth of 125 feet to allow depths as shallow
as 107 feet. This waiver supports and is derivative of the requested incentive. In addition, absent
this waiver, the Project could not fit as many lots as proposed within the Property, which would
result in fewer condominiums than proposed.
d. Floor Area Ratio (“FAR”)
CDP requests a waiver to the 50 percent limit on FAR to allow an FAR of approximately
85 percent. This waiver is necessary to allow the Project to fit onto the Property as designed and
at the density allowed under local code and the SDBL. Absent this waiver, the Project would
have to remove units and would not achieve the density allowed on the Property.
e. Height
CDP requests a waiver to the 30-foot height limit to allow buildings that are 34 feet high.
This waiver is necessary to allow the Project to fit onto the Property as designed and at the
density allowed under local code and the SDBL. Specifically, increasing the height limit allows
