Page 4
there is existing space (approximately 15 feet) behind the curb within the City right-of-way along
Hopyard Road that can accommodate utilities now or in the future.
Absent the waiver, the sound wall would need to move towards the units, resulting in
insufficient room on the Property to fit the end units closest to that wall. Accordingly, the
waiver is needed to allow the Project to achieve the permitted density.
3. Parking
The SDBL provides that, upon the request of a developer, a city shall not require a
parking ratio (inclusive of parking for disabled persons and guests) that exceeds one parking
space per studio or one-bedroom unit. (Gov. Code, § 65915(p)(1).) Parking may be provided
through, among other things, tandem parking or uncovered parking. (Gov. Code, § 65915,
subd. (p)(5).)
Here, the Project would comply with the City requirement for at least two parking spaces
per each of the 48 condominium units. For the nine rental units, all of which are one-bedroom
units, CDP requests the parking ratio available under the SDBL to provide one parking spot for
each of the nine rental units (inclusive of parking for disabled persons and guests). In addition to
the above resident parking, the Project also would include 6 guest parking spots.
* * *
Please do not hesitate to contact me if you have questions about CDP’s SDBL requests or
the Housing Law information we provided in our earlier letters.
We look forward to continuing to work with the City to bring much needed housing,
including affordable housing, to the area.
Sincerely,
Linda C.
