P23-0906, 3132 Tokay Court Planning Commission
4 of 4

The proposed hives conform to all PMC standards outlined in Section 18.103.080. Should the
hives swarm or abscond, the PMC allows enforcement action to be taken by the City.

The standards included in the PMC are intended to protect the public health, safety and
welfare, by ensuring best practices to mitigate swarming, pests and impact bee flight patterns.
See Exhibit G, City Council Agenda Report dated February 17, 2015, for a detailed explanation
of all the performance standards.

HOA APPROVAL
The applicant did not submit approval of the Vintage Hills II Homeowners Association at the
time of the original application. While the City is not a party to and does not enforce an HOA’s
CC&Rs, following the Zoning Administrator decision, the HOA did submit a letter approving the
beehives, dated March 8, 2024. The letter is attached as Exhibit E.

PUBLIC NOTICE
Notices of this application were sent to surrounding property owners and tenants within a
100-foot radius of the site. Staff has provided the location and noticing map as Exhibit F for
reference. At the time this report was published, staff had not received any public comments
about the project.

ENVIRONMENTAL ASSESSMENT
The denial of a project is not an action subject to the California Environmental Quality Act
(CEQA). Therefore, no environmental document accompanies this report.

SUMMARY/CONCLUSION
As described above, the proposed beekeeping operation meets the criteria outlined in PMC
Section 18.103.080. Staff recommends the Planning Commission deny the appeal, thereby
upholding the Zoning Administrator’s decision.

Primary Author:
Emily Carroll, Associate Planner, 925-931-5608 or ecarroll@cityofpleasantonca.gov

Reviewed/Approved By:
Ellen Clark, Director of Community Development
Wes Chung, Deputy City Attorney
