the Alameda County Recorder’s Office, the street, highway, or public service
easement vacated no longer constitutes a street, highway, or public service
easement; and
e. That notice of the Resolution of Summary Vacation has been provided to all entities
having any right, title, or interest in the public service easement.

BACKGROUND
On June 28, 1995, the City Council adopted Resolution PC-95-41, approving Vesting Tentative
Tract Map 6728 (St. John Place). This allowed the New Cities Development Group and The
Stringer Company (New Cities Development) to subdivide an approximately 7.6-acre site into
43 single-family residential lots with common open space. The Vesting Tentative Tract Map
included Lot 11, now known as 870 St. John Court.

On December 4, 1995, the City Council held a Special Meeting and voted to approve the final
map for Tract 6728 (St. John Place) and accept all parcels of land and easements as offered
for dedication, including public service easements. Said final map was subsequently recorded
on February 23, 1996 (Book 224 of Maps at Pages 14 through 17).

On October 7, 1997, the City Council authorized the City Clerk to file a Notice of Completion
for subdivision improvements built as part of Tract 6728, St. John Place. New Cities
Development completed the improvements.

DISCUSSION
The City Council, as a legislative body, has been granted the authority to summarily vacate
public easements that are no longer needed or relevant, provided the regulatory procedure
prescribed by the California Streets and Highways Code is followed. A portion of the public
service easement dedicated by Tract 6728 across the property at 870 St. John Court
(Attachment 3) requires a vacation of unencumbered land where a swimming pool is planned
and where no public utilities exist.

Adoption of a Resolution of Summary Vacation for Public Service Easements (Attachment 1)
and approval of the Quitclaim Deed of Public Service Easement (Attachment 2) across 870 St.
John Court effectuates the removal of an unused public easement without adversely impacting
the City’s rights or obligations.

EQUITY AND SUSTAINABILITY
Not applicable, as this item is an administrative matter of City business.

OUTREACH
Notification letters were sent to easement beneficiaries as required by California Streets and
Highways Code §8335(b)(5). No easement beneficiary submitted an objection to the proposed
vacation.

STRATEGIC PLAN ALIGNMENT
Not applicable, as this item is an administrative matter of City business.

FISCAL IMPACT
