The proposed changes enhance the City’s Stormwater
Ordinance through the deletion of obsolete and non-applicable language, update text
inconsistent with current MRP language, and add current MRP obligations.

RECOMMENDATION
Introduce and waive first reading of an ordinance updating Pleasanton Municipal Code,
Chapter 9.14, to conform with obligations specified in the City's Municipal Regional National
Pollutant Discharge Elimination System Permit.

BACKGROUND
Section 402(p) of the federal Clean Water Act (CWA), as amended by the Water Quality Act of
1987, requires NPDES permits for stormwater discharges from municipal separate storm
systems (MS4s) which are considered potential significant contributors of pollutants to waters
of the United States. The Regional Water Board is the NPDES Program regulating authority
over the San Francisco Bay Region. In 1991, in response to the Regional Water Board's
issuance of the first countywide NPDES permit, the Alameda Countywide Clean Water
Program (ACCWP) was established. The ACCWP comprises the cities within Alameda
County, the County of Alameda, the Alameda County Flood Control and Water Conservation
District, and the Zone 7 Water Agency (collectively referred to as Member Agencies). At the
time, ACCWP developed a Model Stormwater Ordinance for its Member Agencies to provide
the legal authority to implement their stormwater programs consistent with the permit. The City
adopted the Model Stormwater Ordinance in 1992, Ordinance No. 1572, and codified the
Model Stormwater Ordinance under PMC Chapter 9.14, Stormwater Management and
Discharge Control.

Since the incorporation of the Model Stormwater Ordinance framework into the PMC,
stormwater requirements in subsequent reissuances of the NPDES permit have expanded with
the intent of reducing impacts on water quality from urban runoff. The City has made several
minor updates to PMC Chapter 9.14; the most recent update occurred in April 2011 with
Page 274 of 428
