Second Amendment <br /> of <br /> Operator Agreement between <br /> The City of Pleasanton and Pleasanton Golf, LLC <br /> This Second Amendment of Operator Agreement between the City of Pleasanton and <br /> Pleasanton Golf, LLC ("Extension Agreement") is entered into this i5 day of k_, by and <br /> between the City of Pleasanton ("CITY"), a municipal corporation, and Pleasanton Golf, LLC, a <br /> California limited liability company ("OPERATOR"). <br /> RECITALS <br /> 1. On or about June 1, 2010, CITY and OPERATOR entered into Operator Agreement between <br /> The City of Pleasanton and Pleasanton Golf, LLC ("Operator Agreement"). <br /> 2. On April 21, 2015, CITY and OPERATOR entered into an Extension and Amendment of the <br /> Operator Agreement which extended its term to June 30, 2020. <br /> 3. CITY and OPERATOR now desire to extend the term of the Operator Agreement by an <br /> additional six months. <br /> NOW, THEREFORE, in consideration for the mutual promises hereinafter set forth, the <br /> parties hereto agree to as follows: <br /> 1. TERM AND EFFECTIVE DATE. <br /> The term in Section 2.01 of the Operator Agreement as amended and extended by this Extension <br /> Agreement shall end on December 31, 2020 unless otherwise terminated, cancelled or extended <br /> pursuant to Section 12.02.2 of the Operator Agreement. The Effective Date of this Extension <br /> Agreement shall be July 1, 2020. <br /> 2. OPERATOR AGREEMENT INCORPORATED AND TO REMAIN IN EFFECT. <br /> Except as expressly amended herein, the Operator Agreement shall remain in full force and effect. <br /> IN WITNESS WHEREOF,the undersigned have executed this Second Amendment effective <br /> as of the date first above written. <br /> CITY OF PLEA NTON: OPE leasanton Golf, LLC <br /> By: <br /> Nelson Fialho Tom Isaak, President <br /> City Manager <br />
