All districts are underfunded as assessments have not been
increased since the passage of Proposition 218 in 1996. In addition, reserves for capital
replacement are limited or non-existent. Notwithstanding this, all assessment amounts are
proposed to remain unchanged until such time that a complete fiscal analysis, neighborhood
outreach, and a Proposition 218-compliant vote can take place.

To address the funding issues, the City:
• entered into an agreement with the Windsor Homeowners Association (HOA) in
February 2024, with the HOA accepting the routine landscape
maintenance responsibilities and water costs for the Windsor LMD; and
• is embarking on neighborhood outreach (in advance of a 2025 Proposition 218-
compliant vote) for the Ponderosa and Moller Ranch LMDs; and
• is limiting costs by shutting off the water for the Bonde Ranch and Oak Tree
Farm LMDs to build up the reserve for a future Proposition 218-compliant vote.

RECOMMENDATION
1. Open and hold a public hearing to receive comments regarding the levy of annual
assessments for each of the Landscape Maintenance Districts.
2. Adopt a resolution confirming the Engineer’s Report and levying assessments for each of
the Landscape Maintenance Districts.
3. Appropriate $11,560 from the applicable City funds (General Fund, Water Fund and Sewer
Fund) to the respective Landscape Maintenance Districts.

BACKGROUND
The Landscaping and Lighting Act of 1972 authorizes local agencies to impose an annual
assessment on real property benefiting from improvements to pay for constructing and
maintaining lighting and landscaping improvements. Alameda County collects the
assessments as part of the annual tax bill.

At the meeting of May 21, 2024, the City Council approved the updated Engineer’s Report
prepared by the City Engineer relating to each respective assessment district and scheduled
Page 140 of 248
