Ordinance No. 2281 <br />Page 1 of 32 <br />ORDINANCE NO. 2281 <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />AMENDING ORDINANCE NO. 1572 TO UPDATE PLEASANTON MUNICIPAL <br />CODE CHAPTER 9.14 TO CONFORM WITH OBLIGATIONS SPECIFIED IN THE <br />CITY OF PLEASANTON’S MUNICIPAL REGIONAL NATIONAL POLLUTANT <br />DISCHARGE ELIMINATION SYSTEM PERMIT <br />WHEREAS, in 1991, the Alameda Countywide Clean Water Program was established in <br />response to the San Francisco Bay Regional Water Quality Control Board’s issuance of a <br />National Pollutant Elimination System stormwater discharge permit to the member agencies of <br />the Alameda Countywide Clean Water Program; and <br />WHEREAS, in 1991, the Alameda Countywide Clean Water Program developed a <br />Model Stormwater Ordinance for its member agencies to provide legal authority to implement <br />stormwater programs consistent with the National Pollutant Elimination System permit; and <br />WHEREAS, the City of Pleasanton is a member agency of the Alameda Countywide <br />Clean Water Program; and <br />WHEREAS, on July 21, 1992, the City Council adopted Ordinance No. 1572 adding <br />Chapter 9.14 to Title 9, concerning the City’s stormwater management and discharge control <br />program, to the City of Pleasanton’s municipal code; and <br />WHEREAS, on April 19, 2011, Ordinance No. 1572 was amended by Ordinance 2019 <br />Section 1 to allow for administrative citations for stormwater violations; and <br />WHEREAS, on May 22, 2022, the San Francisco Bay Regional Water Quality Control <br />Board reissued a revised version of the National Pollutant Elimination System permit; and <br />WHEREAS, the most recent revised version of the National Pollutant Elimination System <br />permit became effective on July 1, 2022; and <br />WHEREAS, the City Council wishes to amend Ordinance No. 1572 to update Chapter <br />9.14 of the Pleasanton Municipal Code to conform with the obligations specified in the most <br />recent revised version of the City’s Municipal Regional National Pollutant Discharge Elimination <br />System permit. <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br />SECTION 1. Amendment. Ordinance No. 1572 is amended to update Chapter 9.14 of <br />the City of Pleasanton’s municipal code to conform to obligations specified in the City’s <br />Municipal Regional National Pollutant Discharge Elimination System Permit, the specifics of <br />which are included in Exhibit “A. <br />SECTION 2. Severability. If any part of this ordinance is declared invalid by a court, <br />such invalidity shall not affect any of the remaining parts. <br />Page 199 of 248
