LANER
ELECTRIC
SUPPLY
www.laner.com December 7, 2020 Revision
Preliminary Lien Notice FAQ's For Property Owners (Residential and Commercial)
This FAQ is intended to help you understand why a Preliminary Lien Notice is being served to you, avoiding any possible
oversight or problems in the future. This FAQ is sent to all related parties who are in receipt of the Preliminary Lien Notice.
Q: Why is Laner Electric Supply Company(LESCO)placing a lien on my property?
A: The accompanying Preliminary Lien Notice is not a lien. Potential Mechanic's Lien claimants are required by law to serve
property owners like you, with a notice stating that we have the legal right to record a lien and foreclose,in the event that WE
DO NOT GET PAID for materials, labor or services supplied to you or your contractor(subcontractor) on a project at your
property.
Q: Are you sending me this notice because my contractor is dishonest or a bad credit risk?
A: Absolutely not! Service of a Preliminary Lien Notice is a standard operating procedure for construction material suppliers and
distributors in the industry.
Q: Does LESCO have the right to place a lien on my property if payments are not made?
A: In California, Mechanic's Lien Rights are constitutionally granted and are written into the state's Civil Code. Providing a
Preliminary Lien Notice to all relevant parties in a timely manner, gives us the legal authority to record a lien against your
PROPERTY for any unpaid material.
Ensuring that your contractor and/or their subcontractor are paying LESCO for all the materials used at your property will
prevent a lien from being placed. Material suppliers routinely use Mechanic's Lien Law related practices and procedures to
ensure the reliable and timely flow of construction project payments. There are many attorneys that specialize in this branch of
practice.
Q: How can I protect myself against a lien being recorded on my property by LESCO?
A: Before you issue any payments to your contractor(s) make sure that you obtain either a Conditional Progress Lien Release or
an Unconditional Progress Lien Release from LESCO for projects that are still in progress. If the project is close to.completion
or is completed, prior to paying your contractor(s) in full, please obtain a Conditional Final Lien Release(Joint Check)or an
Unconditional Final Lien Release from us directly or ask your contractor to provide you with the release that is appropriate for
the situation.
Conditional Lien Releases will list how much is owed on the date you are requesting for. Unconditional Lien Releases means
that we have received payment. It is customary for Unconditional Lien Releases to be issued after seven(7)business days of
receiving payment, unless it was paid in CASH or ACH(Cash or ACH payments can be released by the following day). State
of California does not require Lien Releases to be notarized. If you insist on a Notarized Lien Release, there is a fee of$100
per release.
Please email us at AR i,laner.com to request for a lien release, a copy of a previous release and/or for a status your project's account
balance. This extra step, taken before you make progress or final payment(s) to your Contractor, could save you a lot of time and
unwanted consequences.
When calling us to inquire about your project account payment/amount-due status and/or a lien release, please refer to the Job Account
ID#that appears in the top left hand corner of the Preliminary Lien Notice.
Please do not hesitate to contact our A/R department at(510) 215-5100 with any other questions or concerns you may have about the
enclosed Preliminary Lien Notice. We are here to assist you!
