City of Pleasanton—Merritt Property Project CEQA Guidelines Section 15183: Projects Consistent
15183 Consistency Checklist with a Community Plan or Zoning

31
SECTION 3: CEQA GUIDELINES SECTION 15183: PROJECTS
CONSISTENT WITH A COMMUNITY PLAN OR ZONING
CEQA Guidelines Section 15183 establishes that projects that are consistent
with the development density established by existing zoning, community
plan, or general plan policies for which an FEIR was certified shall not require
additional environmental review, except as might be necessary to examine
whether there are project-specific significant effects that are peculiar to the
proposed project or its site. Section 15183 streamlines the review process by
providing a statutory exemption for consistent projects and reduces the need
to prepare repetitive environmental studies.
3.1 - Proposed Project Qualifies for No Further Environmental
Review Under CEQA Guidelines Section 15183
CEQA Section 15183 applies to the proposed project since it is consistent with
the General Plan, as amended in conjunction with the 6th Cycle Housing
Element Update, for which the Housing Element Update FEIR has been
certified.
The City of Pleasanton adopted the Housing Element Update and certified
the Housing Element Update FEIR on January 26, 2023. The project site is
included in the Housing Element Update FEIR as Housing Site 22 (Merritt).
The project site is currently designated as Low Density Residential with a
HESO. The Housing Element Update designates the project site as Site 22
(Merritt) and allows for a maximum density of 2 du/ac at the project site.
The project site is shown as Pre-zoned PUD-LDR/HOZ Districts on the City’s
zoning maps. The project site would be annexed by the City as part of the
proposed project, with an allowable density of 2 du/ac.
The project site is 46.4 acres, which would allow for up to 93 units pursuant to
the 2 du/ac density. However, the proposed project of 92 new units qualifies
for a 20 percent density bonus pursuant to the State’s Density Bonus Law
(Government Code 65915) because it provides age-restricted senior housing.
As a result, the proposed 111 units (2.39 du/ac) would be in compliance with
the Low Density Residential designation.
