City of Pleasanton—Merritt Property Project
Consistency Checklist 15183 Consistency Checklist

42
Summary of Housing Element Update FEIR
Conversion of Important Farmland to Nonagricultural Use
The Housing Element Update FEIR indicated that Site 22 (Merritt), which is the
only potential site for rezoning with any mapped Important Farmland (Unique
Farmland and Grazing Land), is not currently utilized for agriculture nor has it
been recently irrigated or used for crops. Site 22 (Merritt) has a dormant
walnut orchard that was abandoned in the 1990s. Furthermore, as indicated
by Site 22’s residential land use designation, the City has planned the site for
low density residential uses since the 1986 General Plan. The Housing Element
Update redesignated the site PUD-LDR with HESO, which is consistent with the
low density residential designation, and the site was rezoned Pre-zoned PUD-
LDR/HOZ. As a result of the lack of crops or irrigation and decades of
planned residential use, the Housing Element Update FEIR concluded that
any potential loss of Unique Farmland would likely occur with or without
implementation of the Housing Element Update. Therefore, the Housing
Element Update FEIR concluded that impacts would be less than significant.
Conflict with Existing Zoning for Agricultural Use or Williamson Act Contracts
The Housing Element Update FEIR indicated that Site 22 (Merritt) is not
encumbered by a Williamson Act Contract, which precludes an impact
related to conflict with an existing Williamson Act Contract. Therefore, there is
no impact.
Conflict with Existing Forest Land Zoning
The Housing Element Update FEIR indicated that none of the housing sites,
including the current Site 22 (Merritt), contain any forest land or timberland,
as defined by Public Resource Code Section 4526, nor do they contain any
timberland zoned Timberland Production, as defined by Government Code
Section 51104(g), and concluded that this precludes the possibility of the
Housing Element Update to conflict with forest zoning of forest land or
timberland. No impact would occur.
Conversion of Forest Land to Non-Forest Use
The Housing Element Update FEIR indicated that the current Site 22 (Merritt) is
adjacent to urbanized land uses and does not contain any forest land. The
Housing Element Update FEIR concluded that this condition precludes the
possibility of the development consistent with the Housing Element Update
converting forest land to non-forest use and concluded no impacts would
occur.
