City of Pleasanton—Merritt Property Project
15183 Consistency Checklist Consistency Checklist

65
Element Update could result in direct or indirect effects on riparian habitat
and other sensitive communities because of project construction.
The Housing Element Update FEIR concluded future development consistent
with the Housing Element Update would be required to comply with adopted
State, federal, and local regulations for the protection of riparian habitat and
other sensitive natural communities. These include the CWA’s regulations of
some sensitive natural communities and aquatic habitats qualifying as
protected wetlands or jurisdictional waters, CDFW’s Lake and Streambed
Alteration Agreement (LSAA), and the General Plan’s goals, policies, and
programs protecting riparian habitat and other sensitive natural
communities. Nonetheless, the potential for impacts to sensitive natural
communities or riparian habitat remains potentially significant, requiring
implementation of MM BIO-1, which requires a qualified Biologist prepare a
project-specific BRA prior to the issuance of grading permits.
Implementation of these goals, policies, programs, requirements, and MM
BIO-1 would reduce potential impacts to less than significant. Therefore, the
Housing Element Update FEIR concluded future development consistent with
the Housing Element Update would not result in significant adverse effects to
riparian habitat or other sensitive natural communities, and impacts would be
less than significant.
Proposed Project Analysis and Conclusion
The analysis under the Housing Element Update FEIR remains consistent with
the proposed project. As discussed above, the project site supports five
habitat types containing developed, ephemeral drainage, intermittent
drainage, non-native annual grassland, and oak woodland (see descriptions
above). The CDFW’s California Sensitive Natural Communities list determined
that the project site supports the “valley oak woodland/riparian habitat
alliance” (oak woodland), which is considered an “S3” sensitive community.
Most of this habitat occurs to the west of Foothill Road, but a small portion of
valley oak riparian habitat occurs along the southern boundary of the
project site.
Based on the most recent Site Plan (Exhibits 4a and 4b), the proposed project
would result in permanent impacts to 38.25 acres of annual grasslands, 0.08
acre of intermittent drainage, 0.17 acre of ephemeral drainage, and 0.44
acre of oak woodland. Temporary impacts resulting from the proposed
project would include 0.77 acre of annual grasslands, 0.01 acre of
ephemeral drainage, and 0.03 acre of oak woodland habitat. Most of the
