City of Pleasanton—Merritt Property Project
15183 Consistency Checklist Consistency Checklist

67
Compliance with these goals, policies, programs, and State and federal
requirements would reduce impacts; however, the potential for impacts to
State or federally protected waters and wetlands remains potentially
significant. Accordingly, prior to the issuance of grading permits, a qualified
Biologist/Wetland Regulatory Specialist would conduct a site investigation
and assessment for projects on sites where potentially jurisdictional wetlands
or waterways are present. MM BIO-1 further requires that if a feature is found
to be jurisdictional or potentially jurisdictional that the applicant would be
required, prior to disturbance of the feature, to comply with the appropriate
permitting process of each agency claiming jurisdiction.
The Housing Element Update FEIR concluded that with mandatory regulatory
compliance and implementation of MM BIO-1 and MM BIO-3, future
development projects consistent with the Housing Element Update would
have less than significant adverse effects related to federally protected
wetlands, waters of the United States, or waters of the State.
Proposed Project Analysis and Conclusion
A jurisdictional delineation, performed by Olberding Environmental, was used
to determine potential project-related impacts to State or federally
protected waters and wetlands. Results of the delineation were verified and
approved by the USACE in 2022, indicating that the project site contains
jurisdictional “other water” features consisting of ephemeral and intermittent
drainages. These features are considered jurisdictional by the USACE,
RRWQCB, and/or the CDFW. A copy of the USACE Verification Letter and
Approved Jurisdictional Determination Form can be found in Appendix C.
The project site contains nine aquatic features:
• Two of the aquatic features (one intermittent drainage and one
ephemeral drainage) were determined to be jurisdictional under
Section 404 of the CWA and total 0.04-acre (approximately 315 linear
feet). The USACE jurisdiction extends to the OHWM of an aquatic
feature.
• The remaining seven ephemeral features were all determined to be
waters of the State and would fall under the jurisdiction of the CDFW
and RWQCB. The State jurisdictional features include 0.08-acre of
intermittent drainage, and 0.26-acre of ephemeral drainage habitat.
The CDFW and RWQCB jurisdiction extends beyond the OHWM to the
top of bank or edge of riparian habitat.
