City of Pleasanton—Merritt Property Project
15183 Consistency Checklist Consistency Checklist

71
project implementation would not conflict with the City’s local policies or
ordinances. Potential biological resource impacts remain less than significant
as described in the Housing Element Update FEIR.
f) Habitat/Natural Community Conservation Plan Consistency
Would the project: Conflict with the provisions of an adopted Habitat Conservation
Plan, Natural Community Conservation Plan, or other approved
local, regional, or State Habitat Conservation Plan?
Summary of Housing Element Update FEIR
The Housing Element Update FEIR indicated that none of the rezoned housing
sites are within any Habitat Conservation Plan (HCP), Natural Community
Conservation Plan (NCCP), or other approved HCP.
All of the rezoned housing sites are within the boundaries of the EACCS;
however, the EACCS is not considered an HCP. The EACCS is intended to
provide guidance during the project planning and permitting process to
ensure that impacts are offset in a biologically effective manner. Individual
development projects would be required to comply with the EACCS, which
would be confirmed during each project’s approval process. As such, there
would be no conflicts with any HCP or NCCP and the Housing Element
Update FEIR concluded there would be no impact.
Proposed Project Analysis and Conclusion
The analysis under the Housing Element Update FEIR remains consistent with
the proposed project. The project site is not located within any HCP, NCCP,
or other approved HCP. However, the project site is located within EACCS
boundaries. To comply with the EACCS regulations, approval of the
proposed project would be required to comply with general mitigation and
minimization measure outlined within Table 3-2 of the EACCS and the
species-specific mitigation and minimization measure (MM BIRD-2) outlined
within Table 3-3 of the EACCS to the extent such measures are identified and
included in the BRA. Additionally, project approval would require
compliance with the City’s ordinance Chapter 17.16.
Implementation of the proposed project would not conflict with the
provisions of an adopted HCP, NCCP, or other approved local, regional, or
State Habitat Conservation Plan. Approval of the proposed project would be
conditioned upon compliance with recommendations provided in the
project-specific BRA (MM BIO-1). This includes general, and species- specific
avoidance and minimization measures as described in EACCS guidelines.
