The City Council, as a legislative body, has been granted the
authority to summarily vacate public easements that are no longer needed or relevant,
provided the regulatory process prescribed by the California Streets and Highways Code
§8330 et seq. is followed. This process requires that the City formally notify those who benefit
from the easement. The beneficiaries of the PSE are those purveyors who operate utility
networks in Pleasanton (PG&E, AT&T, Comcast, and others). If the easement is replaced in a
similar or equivalent configuration, then this is disclosed in the notice, and a simplified
“summary” vacation process is allowed by state law. The easement beneficiaries have the right
to protest the planned vacation. The City sent formal notices to utility purveyors asking whether
they would object to the vacation process; no objections were received.

The public service easement dedicated on the final map for Tract 6275 across the property at
4035 Equus Court requires vacation and replacement with a similar easement to
accommodate the construction of a single-family home. Adoption of a Resolution of Summary
Vacation for Public Service Easement (Attachment 1), approval of the Quitclaim Deed of Public
Service Easement (Attachment 2) together with the City Manager’s acceptance of the Grant of
Public Service Easement (Attachment 3) across 4035 Equus Court would effectuate the
easement adjustments without adverse impact to the City’s rights or obligations.

EQUITY AND SUSTAINABILITY
Not applicable, as this item is an administrative matter of City business.

OUTREACH
Notification letters were sent to easement beneficiaries as required by California Streets and
Highways Code §8335(b)(5). No easement beneficiary submitted an objection to the proposed
vacation.

STRATEGIC PLAN ALIGNMENT
Not applicable, as this item is an administrative matter of City business.

FISCAL IMPACT
There is no fiscal impact associated with this action.

Prepared by: Submitted by: Approved by:

Tommy Nguyen, Associate Siew-Chin Yeong, Director of Public Gerry Beaudin, City
Page 227 of 782
