Page 2 of 2 <br />•The summary vacation of Public Service Easement is made under California <br />Streets and Highways Code §8330 et seq. <br />•The Public Service Easement to be summarily vacated was granted across Lot 6 <br />of Tract Map 6275 (Book 199 of Maps at Pages 51 through 54) as accepted by the <br />City Clerk and as described in detail in the Quitclaim of Public Service Easement <br />across 4035 Equus Court to be recorded together with this Resolution. <br />•A replacement Public Service Easement will be granted by 1400 Foothill LLC in <br />the same general location. <br />•This Resolution is prima facie evidence that the Public Service Easement is <br />determined to be excess. <br />•That from and after the date this Resolution is recorded, the vacated Public Service <br />Easement no longer constitutes a street, highway, or public service easement. <br />•That all entities having any right, title, or interest in the Public Service Easement <br />being vacated have been notified of this action. <br />SECTION 2. The City Manager shall execute the Quitclaim of Public Service Easement <br />across 4035 Equus Court as authorized by this Resolution. <br />SECTION 3. The City Clerk shall cause a certified copy of this Resolution, as attested <br />under seal, to be recorded without acknowledgment, certificate of acknowledgment, or further <br />proof in the office of the Alameda County Recorder together with the fully executed Quitclaim of <br />Public Service Easement across 4035 Equus Court. <br />SECTION 4.
