P24-0334 Planning Commission
7 of 7
ENVIRONMENTAL ASSESSMENT
The Planning Commission recommends that the City Council find that the amendments
to the Pleasanton Municipal Code are within the scope of the 2023-2031 (6th Cycle)
Housing Element Update Environmental Impact Report (State Clearinghouse No.
2022040091) certified by the City Council on January 26, 2023 by Reso No. 23 -1357.
The proposed amendments do not result in new significant effects beyond those
analyzed in the Final EIR. The Planning Commission further recommends that the
proposed amendments are exempt from CEQA review pursuant to: CEQA Guidelines
Section 15268 in that the amendments are necessary to conform to and implement the
ministerial approval processes mandated by State law (e.g. Government Code Section
65915; Public Resources Code Section 21155); CEQA Guidelines Section15061(b)(3)
in that there is no possibility the activity will have a significant effect on the environment.
SUMMARY/CONCLUSION
The proposed text amendments to the PMC are intended to implement the Housing
Element, particularly related to the Density Bonus and major transit stop. As noted in
this agenda report, the Planning Commission may discuss and decide to recommend
text amendments that would allow the separate conveyance of ADUs.
Primary Author: Shweta Bonn, Senior Planner, 925-931-5611 or sbonn@cityofpleasantonca.gov
Reviewed/Approved By:
Melinda Denis, Planning and Permit Center Manager/Deputy Director of Community Development
Ellen Clark, Director of Community Development
Kim Cilley, Assistant City Attorney
