CITY COUNCIL REGULAR MEETING AGENDA PACKET

RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON TO CERTIFY AN EXCEPTION TO THE 180-DAY WAITING PERIOD AND APPROVE AN INTERIM FIRE CHIEF WHEREAS, Fire Chief Joseph Testa is leaving his service with the City/Joint Powers Authority effective December 9, 2024, and WHEREAS, while the City undertakes a recruitment for a new fire chief, an interim fire chief is needed for adequate staffing, public safety, and continuity of operations; and WHEREAS, Joseph Testa is the retired Fire Chief for the City/Joint Powers Authority and is qualified and available to serve as the City’s Interim Fire Chief; and WHEREAS, while the appointment of the fire chief is a duty of the City Manager (see Municipal Code §2.08.100), state law requires that in this circumstance, when a position is vacant and a recruitment is being undertaken if a retiree is assuming the interim position, the City Council must approve such interim appointment (see Cal. Government Code §21221(h)). NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING: SECTION 1. Approves the appointment of Joseph Testa to serve as the City’s/Joint Powers Authority’s Interim Fire Chief beginning on December 10, 2024, during the recruitment for a permanent fire chief, which is anticipated to be completed no later than August 31, 2025. Authorizes the City Manager to: (i) execute the agreement, with minor modifications approved by the City Manager, Director of Human Resources and Labor Relations, and City Attorney; and (ii) to exercise his discretion to terminate the agreement. SECTION 2. This resolution shall be effective immediately upon its passage and adoption.
