ORDINANCE NO. 2291 <br /> <br />AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PLEASANTON <br />AMENDING ORDINANCE NO. 1428 TO UPDATE PLEASANTON MUNICIPAL CODE <br />CHAPTER 13.08 TO ADDRESS UNAUTHORIZED USES OF PARK AND <br />RECREATION FACILITIES <br /> <br /> <br />WHEREAS, on August 15, 1989, the City Council adopted Ordinance No. 1428 <br />repealing then existing Chapter 13.08, “Recreation Facilities” and adopting a revised Chapter <br />13.08, to be entitled “Parks and Recreation Facilities; and <br /> <br />WHEREAS, on August 18, 2015, the City Council adopted Ordinance No. 2125, which <br />amended Chapter 13.08 of the Municipal Code to ban smoking in City parks, trails and adjacent <br />parking lots; and <br /> <br />WHEREAS, there has been a rise in the amount of unauthorized field use by “travel” <br />teams, private athletic trainings, and various sports clinics; and <br /> <br />WHEREAS, there is a need to define “organized activity”; and <br /> <br />WHEREAS, there is a need to clarify that organized activities require an approved use <br />permit; and <br /> <br />WHEREAS, there is a need to include the director’s designee as an additional person <br />able to issue permits; and <br /> <br />WHEREAS, there is a need to include select neighborhood parks to be used with an <br />approved use permit; and <br /> <br />WHEREAS, the Park and Recreation Commission at its November 14, 2024 meeting <br />recommended that the City Council adopt staff’s recommendation to approve an ordinance <br />amending various portions of Chapter 13.08 of the Municipal Code. <br /> <br />NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES <br />HEREBY ORDAIN AS FOLLOWS: <br /> <br />SECTION 1. Amendment. Ordinance No. 1428 is amended to update Chapter 13.08 <br />of the City of Pleasanton’s Municipal Code, the specifics of which are included in Exhibit A, to <br />address the unauthorized use of City park and recreation facilities. <br /> <br />SECTION 2. Severability. If any part of this ordinance is declared invalid by a court, <br />such invalidity shall not affect any of the remaining parts. <br /> <br />SECTION 3. Publication. This ordinance, or a summary of this ordinance, shall be <br />published once within fifteen (15) days after its adoption in “The Valley Times,” a newspaper of <br />general circulation published in the City of Pleasanton, and the complete ordinance shall be <br />posted for fifteen (15) days in the City Clerk’s office within fifteen (15) days after its adoption. <br /> <br />SECTION 4. Effective Date. This ordinance shall be effective thirty (30) days after its <br />passage and adoption. <br /> <br />Page 170 of 350
