Within the applicant response to County comments and their attached
documentation, multiple statements are made about the water infrastructure and Cal Water’s
ability to provide water supply to the new development.

Cal Water is currently working with USL Pleasanton Lakes, L.P., to develop a Letter of Agreement
(LOA) to provide water service to the new development. This LOA has not been finalized as of
the date of this letter, and is still under negotiation. USL Pleasanton Lakes, L.P., has spoken to
Zone 7 Water Agency directly, and has contracted with another firm to evaluate the water
system capabilities separate from Cal Water.

Cal Water has not evaluated the forecasted water system needs of this development, the ability
of Zone 7 to serve this new development under the existing Cal Water contract, nor conducted a
review of the water system evaluation of this new development. As such, all claims in the
documentation regarding the availability of water for the development have not been validated
by Cal Water, the future water purveyor for this development.

Additionally, the statements in the letter regarding the pending process and letters with the
California Public Utilities Commission (CPUC), Zone 7 Water Agency, and the Division of Drinking
Water (DDW), have also not been validated.

Cal Water will continue to work with USL Pleasanton Lakes, L.P. to finalize and validate the
statements and the water supply capability upon agreement and execution of a LOA, but at this
time cannot validate the statements.

Cal Water is glad to answer any questions regarding this development given the information
that we currently have to date.
