Therefore, the DEIR’s assumption that a 6-foot high sound
wall will be erected is not supported. The Project’s failure to include a binding
measure requiring a noise barrier results in a violation of the ECAP, and results in
the Project’s nonconformance with CEQA.

Pursuant to the map in the DEIR, Exhibit 2-6a below, detailing the Project’s
off-site improvements, the Project fails to include a buffer to separate the sewer
treatment plant or bioretention area from the residential units at the Project site.
Sensitive receptors at the Project itself and those at the Senior East County Lakes
Project will be subject to air pollution and noise pollution emission from the sewer
treatment plant and related infrastructure. The DEIR’s failure to provide a buffer
to protect these sensitive receptors violates the ECAP and results in the Project’s
nonconformance with CEQA. The DEIR must be recirculated because new
information of substantial importance must be added, that sensitive receptors at
the Senior East County Lakes Project will be adversely affected by development of
the sewer treatment plant.

157 DEIR, p. 3.12-19.
