Resolution No. 2025-037
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON DOES
RESOLVE, DECLARE, DETERMINE AND ORDER THE FOLLOWING:
SECTION 1. CEQA Findings. Pursuant to CEQA Guidelines, (PRC Section 21000, et seq.),
a Supplemental Environmental Impact Report (SEIR) (State Clearinghouse [SCH] No. 2011052002)
and a Mitigation Monitoring and Reporting Program (MMRP) were prepared and certified by the City
of Pleasanton on January 4, 2012, pursuant to Resolution No. 12-493, for the 2015-2023 (5th Cycle)
Housing Element. An Addendum to the Housing Element SEIR dated/adopted December 27, 2024
for the Avalon Pleasanton project ( to increase the number of affordable units from 46 to 51)
concluded that preparation of a supplemental or subsequent EIR or Negative Declaration was not
required. Additionally, the City Council adopted Negative Declarations on November 6, 1985 and
August 5, 1986 for the Eaves Pleasanton Project. The proposed Second Amendment to the AHA is
within the scope of the above referenced SEIR, Addendum, and Negative Declarations, and
accordingly, no further environmental review is needed.
SECTION 2. Findings of Conformance to Inclusionary Zoninq Ordinance. The City Council
finds that the proposed Second Amendment to the Affordable Housing Agreement between the City
of Pleasanton and the Developer is consistent with the City's General Plan, with the Housing Site
Development Standards and Design Guidelines, and with all applicable requirements of the
Pleasanton Municipal Code Chapter 17.44 Inclusionary Zoning, including the alternative means of
compliance, as those standards were in place in 2012.
SECTION 3. Approves the Second Amendment to the Affordable Housing Agreement
between the City of Pleasanton and Avalon Pleasanton, L.P., a copy of which is attached hereto
as Exhibit A and incorporated herein by this reference; and authorizes the City Manager to
execute the Second Amendment to the Affordable Housing Agreement in generally the form
attached as Exhibit A, subject to minor amendments and the approval by the City Attorney.
Section 4. This resolution shall become effective immediately upon its passage and
adoption.
PASSED, APPROVED, AND ADOPTED by the City Council of the City of Pleasanton at
a regular meeting held on July 15, 2025.
I, Jocelyn Kwong, City Clerk of the City of Pleasanton, California, certify that the foregoing
resolution was adopted by the City Council at a regular meeting held on the 15th day of July, 2025,
by the following vote:
Ayes:
Councilmembers Eicher,
Noes:
None
Absent:
None
Abstain:
None
APPOVEDAS TO FORM:
k ,/J l
Daniel G.
