MEMORANDUM Date: June 5, 2025 To: Susan Hsieh, Finance Director Through: Siew-Chin Yeong, Director of Public Works From: Jeremy Cox, Utilities Division Manager Subject: Sole Source Justification for Shape, Inc. for maintenance, repair, and replacement of Flygt Submersible sewer pumps This memo serves as a justification for selecting Shape Inc. as a sole source provider for the maintenance, repair and replacement of our Flygt Submersible sewer pumps: • Shape, Inc. is the factory representative of Flygt Pumps in our area and is the factory approved for maintenance, repairs, sales, and warranty work on Flygt pumps. • Shape Inc. has over 30 years of experience in the municipal water and wastewater industry. • The Sewer lift stations’ current configuration is built around the Flygt submersible pumps. Flygt Pumps have proven to be a very reliable sewer pump that has minimal clogging and a long service life. • Shape Inc. has proven to be very responsive and professional and has helped the city maintain and repair the submersible pumps with minimal downtime and affect operation. Due to Shape Inc. representing Flygt pumps in our area and their proven track record of responsiveness and the quality of the repairs, they provide the city with the best chance of mitigating downtime of our critical sewer lift stations throughout our system. They also ensure that any repairs or replacement of current pumps meet Flygt’s factory standards and are covered fully under the Flygt warranty. This is consistent with the City’s Purchasing Procedures Manual, which includes provisions for utilizing a sole source provider in lieu of a competitive bidding process.
