Developing clear expectations, ordinances,
and guidelines around the scope and purpose of the program is important, as is developing
guidance for program administration, criteria for what qualifies as a bona fide public art installation
on private property, and allowable use/purpose of funds collected. With this in mind and based on
feedback from other local jurisdictions, staff recommends:
• Adopting an ordinance adding a new chapter 13.20 to Title 13 of the PMC establishing a
public art contribution requirement for non-residential development
• Adopt a resolution updating the City’s Master Fee Schedule to add a public art contribution
In-Lieu fee.

As noted in the background discussion, above, it is recommended the ordinance only apply to
non-residential development.

Development Projects Subject to Public Art Contribution:
• All new non-residential development equal to or greater than 5,000 sq. ft.
• Non-residential building alterations equal to or greater than 5,000 sq. ft.
• A project, other than residential, involving the alteration of an existing structure or
structures where the value of the construction would exceed $1,000,000.

Development Projects Not Subject to Public Art Contribution:
• All residential projects, including condominium conversions
• Child Care Facilities as defined in PMC 17.38.020
• Buildings and facilities used exclusively by nonprofit agencies and institutions exempt
under Section 501(c)(3) of the Internal Revenue Code of 1986 to provide social services to
the general public
• Buildings and facilities used exclusively for religious purposes as defined in the California
Revenue and Taxation Code Section 207
• Street or sidewalk repairs
• Tree planting or median landscaping
