odift
THE CITY OF
i n • m u::i::fl
m••PLEASANTON.
MEMORANDUM
Date: July 22, 2016
To: Karen Gonzales, Deputy City Clerk
e-copy: Jenny Soo, Associate Planner(w/out attachments)
Jay Lee, Associate Planner (w/out attachments)
From: Larissa Seto, Assistant City Attorney
Subject: Records Retention/Destruction
704-05 MetroPCS Wireless —4626 Willow Road
In my continuing review of files for potential destruction, I would like to provide direction on the
above-referenced agreement file. The transmittal slip and file are attached.
The records in this file are not an "agreement". Rather, the records are actually a bond posted in 2008
by MetroPCS for its facility at 4626 Willow Road to meet the requirements of the Pleasanton
Municipal Code that wireless carriers post security that will pay for facility removal in the event the
use ends. See PMC 18.110.240.B.
As a security, I recommend that bonds or other guarantees from wireless carriers be classified as one of
these types of records:
Record Series Record Active 11nactive ITotal
Number Series Title Retention Retention
400 FINANCIAL AND FISCAL FILES
4-04Cash/Surety Bonding Files
404-01 General Information Active Only
404-02 Surety Bonds/Securities In Lieu 2 3 5YAE
404-03 Letters of Credit 2 3 5YAE
404-04 Cash Bonds 2 31 5YAE
404-05 Bond Issues 2 3 5YAE
with this particular MetroPCS Wireless being 404-02 Surety Bond.
I would further recommend that the Planning Division be the first line of review of these types of
records for destruction, as Planning staff will know if these facilities are still in place or have been
removed (and after removal the five years after expiration retention should begin).
