Box 520 Pleasanton, CA 94566 Recording requested Pursuant to Government Code Sections No Fee - 27383 & 6103 APN: 941-2000-63 GRANT OF EASEMENT THIS GRANT OF EASEMENT is made and entered into this _____ day of ___________, 2025 by and between East Bay Regional Park District (“Grantor”) and the City of Pleasanton (“Grantee”). For valuable consideration, receipt of which is acknowledged, Grantor grants to Grantee a permanent easement and right of way for easement for the purpose of installing and maintaining a pipeline (both above and below grade) and supporting appurtenances and miscellaneous equipment, including the right to construct, replace, inspect, maintain, repair, operate said pipeline and maintain telemetry within above grade cabinet or remove any installed item as becomes necessary thereto, over, under, upon and across the following described real property situated in the City of Pleasanton, County of Alameda, State of California, described as follows: Exhibits “A” and “B” attached hereto and made a part hereof. The Grantor reserves the right to use the easement parcel for all purposes not inconsistent with the easement. Upon receipt of a completed application, Grantor will grant a Temporary Park Access Permit within 30 days to Grantee for the purposes of contractor access and staging of equipment and materials within 903-square foot area over and adjacent to this easement parcel. Grantee agrees upon completion of any of its construction hereunder to restore as near as possible the surface of the ground to the condition in which it was prior to the commencement of said construction. If Grantee ascertains that maintenance work is needed over the easement parcel, Grantee will notify Grantor at least 15 days prior to such work to coordinate. Grantee shall indemnify, defend, and hold harmless Grantor against any loss and damage (including legal costs and attorneys’ fee) caused by, resulting from or arising out of the Easement granted under this Agreement, or by any willful misconduct or negligent act or omission of Grantee, or its agents or employees. This instrument shall run with the land and inure to the benefit of the successors and assigns of the parties hereto.
