MEMORANDUM

Date: July 3, 2025

To: Susan Hsieh, Director of Finance

Through: Siew-Chin Yeong, Public Works Director

From: David Bruzzone, Utilities Planning Manager

Subject: Justification for Provider of Services with West Yost

Recommendation:
PWD – Utilities Planning Staff recommends entering into a Professional Services Agreement with West
Yost for a not to exceed amount of $62,223.

West Yost will update the City’s America’s Water Infrastructure Act (2018) compliance documents.

Background:
America’s Water Infrastructure Act of 2018 was signed into law in October of 2018. Under this law, and
for the first time since the Bioterrorism Act of 2002, utilities are required to conduct risk and resilience
assessments (formerly called vulnerability assessments) and prepare or revise emergency response plans.
Utilities must certify to the USEPA that they have achieved these new requirements. The law also
requires that utilities update compliance documents every 5 years. Therefore, certification of the Risk
and Resilience Assessment (RRA) must be achieved no later than December 31, 2025 and the
Emergency Response Plan (ERP) no later than June 30, 2026

Solicitation Process:
PWD-Utilities Planning Staff recommends sole source contracting with West Yost.

West Yost competed successfully in the City’s recruitment process in 2019 to develop the original
AWIA compliance documents. The work products produced met the requirements of AWIA and were
certified to the USEPA. During development of the RRA, West Yost gained focused knowledge of the
City’s cybersecurity protocols. The current updating effort will build upon the analysis that West Yost
developed in the original compliance documents.

Financial Impact:
The Funding for these services will be paid out of the Water Enterprise Fund (420), with our Operations
and Maintenance program under Org 42040602 and Object 430101 – Professional Services.
Docusign Envelope ID: 0F3360EC-0957-4BAE-961E-506A072901B6
