The cost provided below are based of Cost <br />Price Index (CPI) adjustments for providing such services. <br />Table 3, below, provides our proposed unit cost and pricing information, these costs are <br />all inclusive, covering direct and indirect labor costs and overhead costs for completing <br />this scope. <br />Table 3. Our proposal assumes the execution of a mutually-acceptable contract consistent <br />with those concepts, and notwithstanding any terms of the Scope to the contrary, the <br />terms and conditions that will govern the legal and business relation ship between the <br />City of Pleasanton and Murgreen are subject to negotiation and mutual agreement by the <br />parties. Contractual provisions which often require discussion and further agreement <br />include, among other provisions, warranties, indemnities, environmental liability, <br />insurance, uncontrollable circumstances, consequential damages, contractual limits of <br />liability, remedies for breach or default and termination.
