RESOLUTION NO. 2025-055 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> ACCEPTING AND APPROVING THE 2025 ANNUAL REPORT AND 2026 BUDGET OF <br /> THE DOWNTOWN PLEASANTON BUSINESS IMPROVEMENT DISTRICT, <br /> DECLARING THE INTENTION TO AMEND PLEASANTON MUNICIPAL CODE <br /> SECTION 5.28.080 SYSTEM OF ASSESSMENTS TO PERMIT CHANGES TO THE <br /> MANNER IN WHICH THE ANNUAL ASSESSMENT IS LEVIED, AND TO LEVY THE <br /> ANNUAL ASSESSMENT FOR 2026 <br /> WHEREAS, the Parking and Business Improvement Area Law of 1989, Streets and <br /> Highways Code §36500 et seq. ("89 Law"), authorizes the City of Pleasanton to establish <br /> business improvement areas; and <br /> WHEREAS, the City of Pleasanton has heretofore established a Pleasanton Downtown <br /> Business Improvement District ("District"), the purposes and boundaries of which are set forth in <br /> Chapter 5.28, Pleasanton Municipal Code; and <br /> WHEREAS, the City of Pleasanton has heretofore appointed an Advisory Board for the <br /> District; and <br /> WHEREAS, said Advisory Board has prepared a 2025 annual report and a 2026 budget <br /> which satisfies the statutory requirements of Streets and Highways Code §36533 and has made <br /> a recommendation to the City Council to amend the system of assessments in which the District <br /> is levied. <br /> NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF PLEASANTON, <br /> CALIFORNIA, DOES RESOLVE, DECLARE, DETERMINE AND ORDER AS FOLLOWS: <br /> SECTION 1: The 2025 annual report and 2026 budget of the Advisory Board are <br /> accepted and approved. <br /> SECTION 2: The City Council declares its intention to establish the District and to levy <br /> and collect assessments on assessed businesses within the District boundaries for Calendar Year <br /> 2026 pursuant to the 89 Law. <br /> SECTION 3: The business improvement area shall be known as the "Pleasanton <br /> Downtown Business Improvement District." <br /> SECTION 4: The City Council intends to levy and collect assessments within the District <br /> in 2026, for the proposed improvements and activities as provided in Chapter 5.28 of the <br /> Pleasanton Municipal Code. <br /> SECTION 5: The boundaries of the District are shown on the map attached hereto as <br /> Exhibit A. <br /> SECTION 6: Except where funds are otherwise available, the assessments shall be <br /> levied and collected on an annual basis to pay for all improvements and activities within the area. <br />
