<br />THIS ENDORSEMENT CHANGES THE POLICY. PLEASE READ IT CAREFULLY.
<br />RLIPack® PFAS EXCLUSION
<br />This endorsement modifies insurance provided under the following:
<br />BUSINESSOWNERS COVERAGE FORM - SECTION II – LIABILITY
<br />A.The following is added to B. Exclusions:
<br />This insurance does not apply:
<br />(1)“Bodily injury”, “property damage”, and “personal and advertising injury” arising out of, in whole or in part, or in
<br />any way relating to, the:
<br />(a)Manufacture, distribution, sale, resale, design, re-branding, installation, repair, removal, abatement, replacement,
<br />packaging, handling, containment, advertising, detoxification, transportation, or disposal of “PFAS” or any other
<br />material or substance containing “PFAS;”
<br />(b)The actual, alleged, or threatened discharge, dispersal, release, leakage, leaching, friability, flaking, seepage,
<br />migration, escape, or presence of “PFAS;”
<br />(c)Ingestion of, inhalation of, contact with, exposure to, existence of, or presence of “PFAS,” regardless of whether
<br />any other cause contributed concurrently in any way; or
<br />(d)Giving or providing, or failure to give or provide, any warranty, warning, direction, supervision, recommendation,
<br />instruction, or advice in any way involving “PFAS.”
<br />(2)Any sums that any insured or any other entity must pay, repay, or reimburse because of any:
<br />(a)Request, demand, order, statutory, or regulatory requirement, direction, or judicial determination that any insured
<br />or any other entity test for, investigate, monitor, remediate, clean up, remove, detoxify, contain, treat, encapsulate,
<br />neutralize, or take any other action regarding “PFAS”; or
<br />(b)Claim or “suit” for damages arising out of or in any way relating to any request, demand, order, statutory, or
<br />regulatory requirement, direction, or determination that any insured or any other entity test for, investigate, monitor,
<br />remediate, clean up, remove, detoxify, contain, treat, encapsulate, neutralize, or take any other action regarding
<br />“PFAS”; or
<br />(3)Any other loss, cost, or expense arising out of or in any way related to “PFAS”.
<br />B.The following definition is added to Paragraph F. Liability And Medical Expenses Definitions:
<br />“PFAS” means Per- and Polyfluoroalkyl Substances (PFAS) and any alternative or replacement PFAS, including but
<br />not limited to:
<br />(a)Any perfluoroalkyl and polyfluoroalkyl substances, including but not limited to perfluoroalkyl acids or PFOA;
<br />(b)Any Perfluorooctane sulfonic acid or PFOS;
<br />(c)Perfluoroalkane sulfonamides, perfluoroalkyl ether carboxylic acids, fluorotelomer substances, and perfluoro-
<br />alkane sulfonamide substances; or
