Development entitlements often require review for
compliance with the California Environmental Quality Act (CEQA) and its guidelines. In 2021,
the City Council approved a Professional Services Agreement for on-call environmental review
services as needed for development applications and, on occasion, City projects that
necessitate CEQA review. The current on-call contracts expire in June 2025. Staff is
recommending approval of a new set of on-call Professional Services Agreements for CEQA,
under a three-year agreement through June 2028. This includes contracts with the two existing
professional services firms and adding three additional qualified firms to the on-call list to
expand the roster and overall capacity to perform needed work. Most work performed under
this contract is expected to be related to development applications, and therefore fully cost-
recovered from applicants.

RECOMMENDATION
1. Approve Professional Services Agreements with FirstCarbon Solutions, Kimley-Horn,
Rincon Consulting, Raney Planning and Management, and Stantec to provide on-call
CEQA professional services on an as-needed basis. The total aggregate amount for all
contracts shall not exceed $1,500,000 for the term of the agreements (Fiscal Years
2025/26 through FY 2027/28), with the option of up to two one-year extensions.
2. Authorize the City Manager to execute the attached contracts.
3. Authorize the Director of Community Development to approve task authorizations up to
$100,000 for CEQA services funded entirely by a project applicant and up to $25,000
for CEQA services funded by the City.
4. Authorize the City Manager to approve task authorizations up to $300,000 for CEQA
services funded entirely by a project applicant, and up to $100,000 for services funded
by the City.

BACKGROUND
When a development application is in the pipeline for review or a City project is being
implemented, one of the steps is environmental review. Certain environmental review can be
completed by City staff (e.g., categorical exemption determination, notices of exemption, etc.);
however, staff uses CEQA consultants for most other environmental reviews (e.g., Initial
Docusign Envelope ID: C8B6B586-1DFF-4F91-B5A6-A38ED5021B2C
