Item #9
CITY COUNCIL AGENDA REPORT

November 4, 2025
Community and Economic Development

TITLE: PUBLIC HEARING - HEAR AN APPEAL OF THE PLANNING COMMISSION’S
DETERMINATION AND ADOPT A RESOLUTION UPHOLDING THE APPROVAL
OF AN APPLICATION FOR ADMINISTRATIVE DESIGN REVIEW TO INSTALL
SIX, APPROXIMATELY 15-FOOT-TALL, TENNIS COURT LIGHTS IN THE REAR
YARD LOCATED AT 2207 MARTIN AVENUE, FILED UNDER CASE NO. P25-
0236

SUMMARY
On July 18, 2025, the Zoning Administrator (ZA) held a public hearing and approved an
Administrative Design Review (ADR) application to install six, approximately 15-foot-tall, tennis
court lights in the rear yard of a property located at 2207 Martin Avenue, filed under Case No.
P25-0236. On August 4, 2025, the adjacent neighbors/appellants located at 3520 Dennis Drive
filed an appeal of the ZA’s approval to the Planning Commission. On September 10, 2025, the
Planning Commission upheld the ZA’s approval, based on the required findings and subject to
the draft Conditions of Approval listed in Attachment 2, Exhibit A.

On September 25, 2025, the adjacent neighbors/appellants filed an appeal of the Planning
Commission’s determination to the City Council (Attachment 3).

RECOMMENDATION
Adopt a resolution upholding the Planning Commission’s determination upholding the Zoning
Administrator’s determination to approve an application for Administrative Design Review to
install six, approximately 15-foot-tall, tennis court lights in the rear yard of a property located at
2207 Martin Avenue, filed under Case No. P25-0236, based on the required findings and
subject to the draft Conditions of Approval listed in Attachment 1.

BACKGROUND
On February 6, 2024, the City Council approved Planned Unit Development (PUD)-148, which
established R-1-40,000 District development standards for the subject property and allowed
the installation of fencing around an existing tennis court. PUD-148 does not prohibit lighting of
the tennis court; however, a condition of approval for the PUD requires Administrative Design
Review (ADR) approval for any tennis court lighting exceeding eight feet in height.

As required by PUD-148, the applicant submitted an ADR application to install the proposed
tennis court lights. The initial application was denied by the Planning Commission on May 22,
2025, due to insufficient information on potential lighting impacts. The Commission clarified in
making its decision that the denial was based on insufficient technical analysis, not that lighting
should be prohibited altogether.

A revised ADR application (P25-0236), including a detailed lighting and photometric study (see
Attachment 2, Exhibit B), was submitted on June 2, 2025. Following a public hearing on July
Page 74 of 323
