And, as detailed on Page 4 of 6 of the Planning Commission
Agenda Report (Attachment 2), the applicant was also required to install screening vegetation,
which has matured to a height of 6-9 feet since it was planted.

Regarding the appellants’ ability to attend the prior appeal hearing, the PMC prescribes
timelines for scheduling hearings for appeals (PMC 18.144.030), requiring such hearings to be
scheduled within 40 days of the appeal being filed (August 4, 2025). While staff made its best
effort to schedule the hearing at a time both the appellant and applicant were available, the
hearing was ultimately scheduled on September 10, 2025, to meet the PMC timelines and
staff’s reasonable ability to prepare the Agenda Report and provide the required public hearing
notice during the 40-day period.

Design Review Considerations and Conclusion
PMC Section 18.20.030 sets forth the scope of review criteria to be addressed in reviewing
projects subject to design review. These criteria are included in the draft Resolution (Exhibit A).
As described, the Planning Commission denied the prior appeal and upheld the Zoning
Administrator’s approval, based on the consideration of the proposed tennis court lighting
conformance to the PUD approval, and design measures, supported by appropriate technical
analysis, all of which indicate that the project would minimize potential off-site impacts to
neighboring residences.

As described in Exhibit A and based on the information and analysis provided in this Agenda
Report, staff recommends the City Council make the required findings to affirm the Planning
Commission's approval of ADR Case No. P25-0236

EQUITY AND SUSTAINABILITY
Not applicable, as this item is a routine matter of City Business.

OUTREACH
Notice of this application was sent to surrounding property owners and tenants within a 1,000-
foot radius of the site and published in the newspaper. The noticing map is included in
Attachment 4. At the time this report was published, staff has not received any public
comments. However, neighbors who received notice of the September 10, 2025, Planning
Commission public hearing expressed concerns regarding the proximity of the tennis court
lights to nearby residences, potential lighting and traffic impacts, the height of the light poles,
aesthetic considerations, tennis court setbacks, and consistency with the Planning
Commission’s prior denial (Attachment 2, Exhibit D). Any additional public comments received
after publication of this report will be forwarded to the City Council.

STRATEGIC PLAN ALIGNMENT
Not applicable, as this item is a routine matter of City Business.

FISCAL IMPACT
Not applicable, as this item is a routine matter of City Business.
