Achieve 95% “On-time” <br />performance over the course of <br />a month (passenger is picked up <br />between the scheduled pick-up <br />time and 20 minutes after the <br />scheduled pick-up time). <br />B. No more than 0.5% of the trips <br />will fall into the very late trip <br />category (passenger is picked <br />up 41-60 minutes after the <br />scheduled pick-up time). <br />C. “60+ Minute Late Trips” will be <br />investigated to determine cause. <br />CONTRACTOR will notify <br />CITY within 24 hours of a “60+ <br />Minute Late Trip” incident that <br />occurred as a result of traffic, <br />rider error, or any event that <br />occurs outside the control of the <br />CONTRACTOR (passenger is <br />picked up more than 60 minutes <br />after the scheduled pick-up <br />time). <br />D. Annual one-way rides <br />expectations are 8,500. <br />Liquidated damages for 1A: <br />- $500 penalty assessed to <br />CONTRACTOR each month on- <br />time performance is below 90%. <br /> <br />Liquidated Damages for 1B: <br />- $100 penalty assessed to the <br />CONTRACTOR per incident, <br />each month when “very late <br />trips” account for more than <br />0.5% of trips. <br /> <br />Liquidated Damages for 1C: <br />- $100 penalty assessed to <br />CONTRACTOR for each <br />incident where a passenger was <br />picked up 60 minutes or more <br />after the scheduled pick-up time. <br />CITY will not assess penalty on <br />“60+ Late Trips” that are outside <br />of the control of the <br />CONTRACTOR. <br />Page 311 of 373
