required to wait a specified period before re-submitting a substantially similar
application.

It is important to emphasize that in no case would an early City Council authorization to submit
an application constitute an approval or entitlement, since such approval could only be
required to be granted following the comprehensive project and CEQA review.

Staff recommends the City Council direct staff to draft a formal policy reflecting this approach
for consideration and adoption at a future meeting, inclusive of any additional input from City
Council on the process and its parameters. Staff also recommends developing proposed
application fees for processing of such applications based on the estimated actual cost of staff
time to process them, for inclusion in the Master Fee Schedule.

EQUITY AND SUSTAINABILITY
Through legislative approvals, the City has the opportunity to review projects to ensure they
meet equity and sustainability goals, whether ensuring such projects include affordable
housing, incorporating green building measures, or locating in areas close to transit and
services.

OUTREACH
No outreach was conducted, since this is a routine item of City business.

STRATEGIC PLAN ALIGNMENT
While not directly called out as a Strategy, this item advances Strategic Plan Goal A. Funding
our Future, since it provides a path for developers seeking to advance re-zoning and re-use of
existing properties for potentially more economically viable and fiscally sustainable uses.

FISCAL IMPACT
There is no fiscal impact associated with this action. However, as outlined above, the fiscal
impacts and/or benefits of re-zoning actions would be important analysis to consider as part of
any decision by City Council to accept an application. Establishing appropriate fees / cost
recovery for staff or professional services needed to support these discretionary applications is
proposed as part of staff's recommendation.

Prepared by: Submitted by: Approved by:

Ellen Clark, Director of
Community and Economic
Development
Ellen Clark, Director of Community and
Economic Development

Gerry Beaudin, City
Manager

Attachments:
1.
