THIRD AMENDMENT TO AGREEMENT <br /> <br />This Third Amendment to Agreement ("Third Amendment") is entered into this 16th day of December <br />2025 by the City of Pleasanton ("City") and Tri-Valley Haven ("Contractor”). <br /> <br />Whereas, on July 1, 2023 the City and Contractor entered into a Professional Services <br />Agreement Concerning the Allocation of State of California Department of Housing and Community <br />Development Permanent Local Housing Allocation Program (PLHA) Funds for Fiscal Year 2023 <br />(23/24), which was amended by the First Amendment to Agreement dated October 22, 2024 and by <br />the Second Amendment to Agreement dated September 10, 2025 (collectively the “Agreement"); and <br /> <br />Whereas, on December 16, 2025 additional State of California Department of Housing and <br />Community Development Permanent Local Housing Allocation Program Funds were approved to be <br />provided to Contractor; and <br /> <br />Now, therefore, in exchange for valuable consideration, the receipt of which is hereby acknowledged, <br />the parties agree as follows: <br /> <br />1. Section 3. Term. The term of this Agreement is extended to June 30, 2027. The <br />remainder of Section 3 remains unchanged. <br /> <br />2. Section 4. Compensation. The Program Budget will be increased by an additional <br />$217,364.85 in State of California Department of Housing and Community Development Permanent <br />Local Housing Allocation Program (PLHA) Funds. <br /> <br />3. This Third Amendment may be executed in multiple counterparts, each of which shall <br />be an original and all of which together shall constitute one agreement. Counterparts may be delivered <br />via facsimile, electronic mail (including pdf or any electronic signature complying with U.S. federal <br />E- Sign Act of 2000 (15 U.S. Code §7001 et seq.), California Uniform Electronic Transactions Act <br />(Cal. Civil Code §1633.1 et seq.), or other applicable law) or other transmission method, and any <br />counterpart so delivered shall be deemed to have been duly and validly delivered and be valid and <br />effective for all purposes. <br /> <br />4.
